Chapter 7 bankruptcy is often called the "fresh start" bankruptcy, because the court will discharge certain types of debt altogether. You will have to give the court a complete list of your assets — equity in your house and car, cash, and savings. You will also have to list your debts and anything you have given away, and agree to cooperate with the rules of the bankruptcy court. After reviewing your financial situation in light of the bankruptcy code, the court may discharge unsecured debt.

What debt is dischargeable?

Bankruptcy laws allow the court, through Chapter 7 bankruptcy, to discharge unsecured consumer and personal debt, including credit card debt, medical bills and personal loans. If you file Chapter 13 bankruptcy, any unsecured debt left after your three to five year payment plan is completed will be discharged.
