Non-dischargeable Debts and Bankruptcy

Certain debts are discharged by the court during bankruptcy, particularly credit card debt. However, under the bankruptcy code, you will still be responsible for certain non-dischargeable debts, even after a Chapter 7 bankruptcy. Back child support, alimony, some tax debt and most federal student loans will still be your responsibility.

Your creditor can appeal your bankruptcy filing

If you can show that repaying a student loan will be an undue burden, the court may discharge the loan. However, that is a very difficult claim to support. If your creditor convinces the court that dischargeable debt such as medical bills, personal loans and credit card debt should be paid during or after a Chapter 7 or Chapter 13 bankruptcy, the debts will not be repaid.

Payments on non-dischargeable debt will be included in the payment plan that is part of a Chapter 13 bankruptcy. Your lawyer may be able to negotiate payment reductions or interest rate reductions on your home mortgage or credit card debt, and negotiate with the IRS for reductions in tax debt, either as a bankruptcy alternative or during Chapter 13 proceedings. Tax collection will be handled as part of the trustee payment process.
